SU files Amicus Curiae Brief in DADT case

WASHINGTON, D.C. - Servicemembers United, the nation's largest organization of gay and lesbian troops and veterans, has filed an amicus curiae brief with the Ninth Circuit Court of Appeals as the Court considers whether to reinstate an injunction barring enforcement of "Don't Ask, Don't Tell" ( DADT ) . The case in question, Log Cabin Republicans vs. United States of America, resulted in a ruling by District Court Judge Virginia A. Phillips last year that the DADT law is unconstitutional and in an injunction barring enforcement of the law, but that injunction was stayed pending appeal by the Justice Department.
"Servicemembers United submitted its own amicus brief to advance the unique argument that its members would be irreparably harmed if the injunction is not reinstated immediately," said Alexander Nicholson, Executive Director of Servicemembers United. "Specifically, we argue that many of our members will permanently 'age out' of eligibility to enlist, re-enlist, or commission if the injunction is not reinstated. We also strongly support Log Cabin's arguments that the dismissal of its equal protection claim should be reversed and that a standard of heightened scrutiny should be applied in the case."
