CHICAGO, Sept. 3, 2013 — A new book from ABA Publishing, written by a transgender attorney, offers a comprehensive state-by-state look at the legal landscape and practical hurdles of how to change one's sex.
Transgender Persons and the Law covers nearly everything you can think of, from how to change your birth certificate to how landmark court decisions affect housing, military service, veterans benefits and much more. The book will serve as a valuable resource for legal practitioners on the various state laws, so they can help steer clients through the process of a sex change in any particular state, as well as on applicable federal law, such as with immigration status. It comes with a CD containing a complete set of forms for all 50 states and the District of Columbia for name changes and, for those jurisdictions that allow it, birth certificate changes.
But this straightforward, informative and groundbreaking book is far more than a compendium of law and cases. Transgender Persons and the Law provides readers a better understanding of why transgender people have been referred to as immigrants into the world of men and women, and it captures the often emotional and tragic stories of people who have been harassed and sometimes fatally harmed because of their gender identify. As the author Ally Windsor Howell notes, the bias and prejudice toward transgender people leads to an inordinate amount of violence directed against them.
Howell, who now lives in Elmira, N.Y., previously practiced in Alabama. She has about 25 years of legal experience, including a stint as an assistant attorney general and chief counsel of the Alabama Medicaid Agency. She has written extensively during her career, authoring annual supplements for three legal books as well as numerous articles for newspapers, bar journals and other publications. The book's foreword is written by Phyllis Randolph Frye, a Houston attorney who is considered the first out-of-the-closet transgender judge in the United States.
