ACS: Prop 8 counter to core constitutional value of equality

Washington, D.C. The U.S. Supreme Court heard oral argument today in Hollingsworth v. Perry, which centers on a constitutional challenge to California's Proposition 8, which stripped lesbians and gay men of the right to wed in the California. The following is a statement from American Constitution Society President Caroline Fredrickson on today's arguments:
"Proposition 8 is a law that runs counter to the core constitutional value that we are all equal under the law. Laws that treat LGBT Americans as second class citizens are a clear violation of the Constitution's Equal Protection Clause. The promise of equal protection cannot be realized as long as laws such as Proposition 8 survive. We believe the Supreme Court justices should either let the Ninth Circuit's opinion stand or find that discriminatory laws like Proposition 8 are not compatible with the Constitution's prohibition against laws that deprive people of liberty or equal protection."
