More developments have taken place regarding the case of Jussie Smollett—the openly gay Empire actor who claimed he was attacked in a hate-motivated crime Jan. 29, CBS 2 Chicago reported.

Ola and Abel Osundairo—the two brothers involved in said attack—have reportedly claimed that Smollett was behind creating a racist letter ( cut out from magazines to form words ) sent to the actor on the set of Empire. Also, media outlets reported that the two brothers were seen on a rideshare video camera before being dropped off near the attack site.

Also, the brothers have told detectives the three men rehearsed the attack days prior to it happening, and that Smollett paid them $3,500.

In addition, Cook County State's Attorney Kim Foxx has recused herself from the case. ( "Out of an abundance of caution, the decision to recuse herself was made to address potential questions of impartiality based upon familiarity with potential witnesses in the case," a spokeswoman emailed ABC 7 Chicago. ) First Assistant State's Attorney Joseph Magats will now take over the case.
