Smollett fighting special prosecutor appointment

Weeks after an Illinois judge ordered that a special prosecutor be appointed to investigate the handling of Jussie Smollett's abandoned criminal case, the embattled actor said July 19 that he wants that move nullified, Deadline reported.

Smollett claimed he was the victim of a racist and homophobic attack Jan. 29 in Chicago's Streeterville neighborhood. Later, he was arrested and charged with filing a false police report in connection with the incident, which Chicago authorities said was a hoax after siblings Ola and Abel Osundairo said the situation was a set-up. ( Cook County State's Attorney Kim Foxx's office dropped charges in March. )

Attorneys Mark Geragos and Tina Glandian—facing their own federal defamation suit from the Osundairo brothers—want the matter modified if they cannot have charges dismissed in a July 26 hearing, and hope to spare Smollett further prosecution. The Cook County inspector general's office is conducting its own investigation over why Foxx's office dropped all charges against Smollett.
