Lambda Legal, on Feb. 15, filed a Notice of Appeal in a lawsuit by a lesbian who said that she was harassed when she was at a senior living facility in suburban Niles, according to organization officials.
Marsha Wetzel sued Glen St. Andrews Living Facility in 2016, alleging that the facility failed to protect her against ongoing harassment, discrimination and violence because she is gay. Wetzel moved in to the facility after her longtime partner died and she was evicted from their home by her partner's family. At Glen St. Andrews, the suit alleged, she was subjected to repeated anti-gay slurs when fellow residents found out that she had been in a relationship with a woman.
A judge dismissed Wetzel's lawsuit in January. At the time, Karen Loewy, senior attorney and seniors program strategist at Lambda Legal, said in a statement, "We feel the District Court's dismissal of Marsha's lawsuit does not appropriately apply the law and we're confident that the Seventh Circuit Court of Appeals will agree. All seniors should feel safe in their homes. But Marsha Wetzel has been attacked at Glen St. Andrew simply because of who she is and whom she loved: a woman with whom she lived and nurtured a family for 30 years. This kind of discrimination and harassment is not only wrong, it's illegal."
